Philippines Enacts R.A. 10175 or the Cybercrime Prevention Act of 2012

 

The Philippines has a new law that defines internet and computer offenses.   President Noynoy Aquino signed into law Republic Act No. 10175, otherwise known as the Cybercrime Prevention Act of 2012.

Up until the passage of the Cybercrime Prevention Act of 2012, internet use in the Philippines has been practically free of censorship.  The new law aims to put users of the internet and computers in check by defining violations related to their use.

Essentially, the Cybercrime Prevention Act of 2012 divides offenses into three categories: (a) offenses against the confidentiality, integrity and availability of computer data and systems, (b) computer-related offenses, and (c) content-related offenses.

The first category includes offenses such as hacking and cybersquatting.  The second category includes offenses such as forgery, fraud and identity theft.   The third category is more interesting since it includes offenses such unsolicited commercial communications and libel. The law now penalizes those who send unsolicited commercial communications which seek to advertise, sell, or offer for sale products and services.   This should put a stop to those spam emails and other unwanted commercial communications.  The law however provides for exceptions to this offense.

The Cybercrime Prevention Act of 2012 also now criminalizes libel done by using a computer system.  You better start reading the law and think twice before posting libellous comments online.  This could spell an end to cyber bullying.

    Kindly review the contents of Article 355 of the Revised Penal Code before you post against libel. This law has been around for quite some time now. The only difference is that it now covers digital environment.

  2. di nman kelangang alisin ang internet eh..ang dapat alisin eh ung mga taong naninira lang ng kapwa at ung sobra na kung gumamit.ung mga hubad na ktwan at ung mga pinallabas na mga blod story..yan sna ang tanggalin nio.at ska bakit kya di nio muna asikashin ang ibang problema ng pinas…tulad n lang ng kung panu nio masusulosyunan ang kahiran, ang pagdami ng papolasyon,ang pagtaas ng dollar pra sa aming mga ofw.sa mga users nman din kc ng internet we need to know first  the dis and advantage of using computer.hindi ung ggamit na lang basta…

  3. Sa totoo lang, kailangan natin ng batas laban sa cyber crimes. Ang ibang mga bansa naman ay may mga batas na tungkol dito. Ang controversial na parte ng ra 10175 ay ang libel. May maganda at pangit na maidudulot ang pagpaparusa sa libel. Ang maganda e pwedeng mabawasan ang mga comments na halatado namang personal at/o walang kinalaman sa issue. Ang dami ko ng nabasang personal na atake sa mga officials, itatanggi siguro ng iba pero maraming namemersonal. Ang pangit nga ay mababawasan ang freedom of speech. Baka konting comment mo lang sa maling ginawa ng mga officials e parurusahan ka na. Sa tingin ko kailangang pag-aralan muna yung libel part ng batas, dagdagan siguro ng conditions o alisin na lang para walang problema. Pero, talaga, kailangan natin ng law against yung mga ‘serious’ cyber crimes like hacking and identity theft kaya sana ayusin ng mga nasa pwesto ang batas na ito.

  4. pwede din nating sabihin na this might be his little step to change and remove the democracy  but looking at the other side,it can somehow help us pero mamawala nga lang ang freedom of expressing emotions and opinions because pwede nila itong iclassify as bullying instead of opinion agains them.
