NTC wants to regulate sale of used and refurbished gadgets

The National Telecommunications Commission (NTC) is proposing new rules to regulate the sale of used and refurbished mobile phones, tablets, and gadgets in the Philippines. The goal is to stop stolen, tampered, and defective devices from flooding the market.

The draft circular covers importation, dealer accreditation, labeling, and sale of refurbished units. During a public hearing on September 23, the NTC presented its plan to allow importation and sale of approved refurbished devices.

These units must be untampered, boxed under the authorized dealer’s brand, and sold with a one-year repair or replacement warranty.

The hearing was attended by telecos, applicants, and other stakeholders. Written comments raised concerns about intellectual property and manufacturers’ rights. The NTC clarified that only properly documented and type-approved devices can be imported. Units must be labeled, graded, and warranted by authorized dealers before reaching consumers.

Unlicensed entities caught importing or selling used or refurbished devices will face administrative penalties. The NTC is also opening the proposal for public feedback. The agency will accept comments and suggestions via email until October 1, 2026.
